How is Amazon able to expand same-day delivery and not say they have a local presence--and thus avoid collecting States' sales tax?

This starts to get into local sales tax law, which I’m admittedly not an expert at, but I believe the issue is where the product is bought, not how quickly the product is delivered. So, this shouldn’t have any bearing on Amazon’s battle to not have to pay state sales tax.
