U.S. Court Strikes Huge Blow To Chinese Dads Whose Fetuses Were Aborted

Chinese men aren’t entitled to asylum in the U.S. just because China’s strict one-child only policy forced their wives to have an abortion.But the women who had the abortions are welcome.

The case started when Xian Tong Dong came to the U.S. about six years ago after his wife was forced to have an abortion, claiming the dad feels just as much pain as the mum does, The Wall Street Journal’s Law Blog reported Wednesday.

But the First Circuit Court of Appeals wasn’t buying it.

Judges acknowledged Dong’s arguments held a “certain superficial appeal,” but they and four other courts ruled that husbands can’t be granted asylum under such circumstances.
