Late last year, Heather Peters took Honda to small claims court for misleading mileage claims on her Civic hybrid.People who thought she had no chance had to eat their words when she won.
But now, according to the AP, Honda appealed the decision in Los Angeles Country Superior Court, where it was just overturned.
Peters, a former lawyer, won a $10,000 judgement against Honda earlier this year in small-claims court, where Honda couldn’t use a lawyer, as she said her Civic Hybrid was not returning close to Honda’s claimed 50 MPG rating.
There was a class action settlement for $100 to $200 per owner, but Peters declined and decided to sue on her own. She had hoped to give a voice to the little guy.
Superior Court Judge Dudley grey ruled that while her case had merit, the government dictates regulations regarding fuel economy numbers and advertising those numbers. He also noted that a majority of owners do achieve the advertised mileage.
